In connection with the changes introduced by the resolution of the NCRECP dated October 5, 2022. No. 1272 to the Rules of the Retail Market of Electric Energy approved by Resolution of the NCRECP No. 312 dated 14.03.2018 (hereinafter the “Rules”), in terms of the definition of residential consumer facilities, to which currently only the residential real estate facilities specified in clause 14.1.129 of the Tax Code of Ukraine, and taking into account the definition that consumption for household needs can take place only at the facility of a household consumer, further supply of electricity at fixed prices, which are established by Resolution No. 483 of the Cabinet of Ministers of Ukraine dated June 5, 2019, it is not considered possible for separately built individual garages that are owned or used by individuals.

In order to bring the contractual conditions in line with the norms of the amended legislation, we inform you that from January 1, 2023, the terms of the Commercial Offer "1-UP" will not apply to separately constructed individual garages owned or used by individuals.

According to the terms of the commercial offer "1-UP", if in the process of execution of the Agreement the Supplier establishes the Consumer's non-compliance with the selected commercial offer, the Consumer must choose another commercial offer, which he shall notify the Supplier of by submitting the corresponding application-joining within 5 working days from the date of receipt of the relevant notification from the Supplier. If the Consumer does not choose another commercial offer within the above-mentioned period, the Supplier independently determines a new commercial offer, under the terms of which the supply of electric energy will take place. During disputed periods, the Supplier has the right to recalculate the prices of another commercial offer chosen by the Consumer or determined by the Supplier independently after the deadline set for submitting the application for joining.

In view of the above, we inform you that if no other commercial offer is selected within the above-mentioned period (until January 1, 2023), delivery will be made on the terms  Commercial offer "2/2-UP", the terms of which can be found on the website of LLC "OOEK" in the section For business/Delivery by universal service/Contractual relations/Agreement on the supply of electricity with PUP .

We also inform you that the Consumer has the right to disagree with the proposed changes, about which he must notify the Supplier in writing in accordance with clause 3.2.4. Rules within 5 working days from the date of publication of this message. In this case, the Agreement will be considered prematurely terminated without the application of any fines, and in the event that another electricity supplier is not selected in accordance with the procedure provided for in Section VI of the Rules, the supply will be carried out by the "last resort" supplier.
